1. Agreement to Terms

By installing the PhoneVyapar mobile application or accessing our online SaaS dashboard, you agree to comply with and be bound by these Terms and Conditions. These terms govern the relationship between PhoneVyapar (represented by developer Harshal Jariwala) and your registered retail mobile business ("Dealer", "User", "you").

If you do not agree to these terms, you must immediately uninstall the application and cease accessing all backend features and compliance portal features.

2. Subscription Licensing

PhoneVyapar is a commercial Software-as-a-Service (SaaS) application. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for the management of your retail secondhand mobile store.

• Free Trial: We offer a 7-day free trial for new shops. Upon completion of the trial, access to data register exports and IMEI checks is suspended unless a paid license key is activated.
• License Limits: A single shop account is restricted to logging inventory and customers for the registered physical shop location. Sharing login tokens across different entities is prohibited.

3. Payments & Billing

Paid subscription plans are billed on a recurring monthly or annual schedule as selected during purchase:

• Billing Channels: Payments are processed securely online using digital gateways (including UPI, Net Banking, and Cards integrated via Razorpay).
• Taxes: All subscription fees are displayed in Indian Rupees (INR) and are subject to applicable GST rates.
• Renewal: Subscriptions must be renewed manually before the expiration date to prevent account lockout. We send notification reminders to registered phone numbers.

4. Refunds & Cancellation Policy

Because PhoneVyapar provides a digital SaaS platform with a fully functional 7-day free trial to check feature compatibility:

• No Refunds: Paid monthly and yearly subscription fees are non-refundable. We do not provide prorated refunds or credits for partially used license periods.
• Cancellation: You may request the cancellation of your subscription at any time. Your account will remain active with full features until the end of your current prepaid billing cycle, after which it will revert to an inactive state.

5. Dealer Responsibilities & Data Truthfulness

As a condition of your license, you represent and warrant that:

1. Accurate Logs: You will input genuine customer information, original Aadhaar card images, real signatures, and correct handset IMEI numbers. Registering fake or fabricated data is a breach of service.
2. Blacklist Compliance: You will not deliberately upload false theft report flags to the IMEI blacklist to lock out competing dealers.
3. Lawful Operations: You will use the generated registers only for lawful compliance with local police guidelines. We do not guarantee that the export format matches requirements in all states, and the responsibility to verify formats with local stations remains yours.

6. Limitation of Liability & Disclaimers

The application is provided "as is" and "as available". We do not guarantee that the software will be completely error-free or that the central blacklist database contains records of every stolen phone in India.

7. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any legal disputes or claims arising from the use of PhoneVyapar shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
